1. Who you are contracting with

These terms are an agreement between you and Tropivio (“Tropivio”, “we”, “us”), the operator of tropivio.com and the provider of the services described here. You can reach us through the contact form at tropivio.com/contact.

2. Acceptance of these terms

By creating an account, purchasing a package, or otherwise continuing to use Tropivio, you agree to these terms. If you use Tropivio on behalf of a company or agency, you confirm that you are authorised to bind that organisation; if you use it as an individual, you confirm you are of legal age. If you do not agree, please stop using the service.

3. What Tropivio is

Tropivio is an online marketplace that connects sellers (owners and estate agents) of property in South America and the Caribbean with potential buyers. Tropivio is not a party to any sale and does not act as an estate agent, broker, or legal, tax or investment advisor.

4. Listing packages and payment

Sellers purchase a listing package to publish properties. Each published listing stays online for 3 months from the publication date, after which it is removed automatically unless it is renewed or upgraded. Payment, billing, currency, taxes, invoicing, cancellation and refund mechanics are handled by Paddle and are governed by the Paddle Buyer Terms (paddle.com/legal/checkout-buyer-terms). Our own refund commitments are set out in our Refund Policy.

5. Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

6. Seller responsibilities

Sellers guarantee that they are authorized to sell the listed property, that all information and photos are accurate and that they hold the rights to the content they upload, and that the listing complies with local law. You grant Tropivio a limited, non-exclusive licence to host, display and promote your listing content for the purpose of operating the marketplace.

7. Listing content and contact details

Listings may not contain any contact details or direct references to the seller or agency. It is strictly forbidden to mention an agency or office name, phone number, WhatsApp number, email address, website, or social media account in the title, description, photos or videos of a listing. All initial contact between buyers and sellers goes through Tropivio: a buyer can only see the seller's contact details after creating a free account. We may remove or reject listings that break this rule, and repeated violations can lead to suspension of the account without refund of unused listing credits.

8. Buyers

Buyers browse and contact sellers free of charge. Any negotiation, viewing, contract or payment takes place directly between buyer and seller. Always seek independent legal advice in the country of the property before purchasing.

9. Acceptable use

You must not misuse Tropivio. That includes any unlawful use, fraud, spam, misleading or duplicate listings, infringing someone else's intellectual property, uploading malware, scraping, probing or otherwise interfering with the security or integrity of the service.

10. Intellectual property

Tropivio owns the platform and all intellectual property in it, including the software, design, editorial content, country dossiers and the Tropivio name and branding. You receive a limited, non-exclusive, non-transferable right to use the service within your chosen plan. You may not copy, resell, reverse engineer or circumvent technical limits of the service.

11. Service availability

We work to keep Tropivio available and accurate, but we do not guarantee uninterrupted or error-free performance. Access may be temporarily unavailable for maintenance, updates or reasons outside our reasonable control. To the fullest extent permitted by law we disclaim implied warranties of merchantability and fitness for a particular purpose.

12. Suspension and termination

We may suspend or terminate access to an account or remove listings in the event of a material breach of these terms, non-payment, a security or fraud risk, or repeated or serious policy violations. Where the circumstances allow, we will tell you why and give you a chance to fix the issue. You may close your account at any time by using the contact form at tropivio.com/contact.

13. Liability

Tropivio does not verify every listing and is not liable for the accuracy of listings, the conduct of users, or the outcome of any transaction. We are not liable for indirect or consequential loss, including lost profits, data or goodwill, and our total liability is limited to the fees you paid us in the 12 months before the claim. Nothing here excludes liability for fraud, death or personal injury where the law does not allow it.
